Affidavit of support ( joint sponsor) cr1 visa

Hello everyone 👋

 

We're in the second stage of the process cr1 visa At the NVC  stage ,trying to find a joint sponsor

My wife is retired she is an American (petitioner) living with me abroad the states for 5 years now and her income is not enough to sponsor me , her ex husband still a good friend with her , he offered to be the sponsor for the visa is this ok with the Immigration officers or it might rise and eyebrow 🤔

Should we find someone else or it's ok 

Please anyone can give us an answer thank you.

I'd find a different joint sponsor.

Agree with @milimelo .  I think it will open a lot of unwanted scrutiny.

@Crazy Cat some others in FB groups says it's fine as long as the NVC does not says he need to be this or that it says only family members or friends it's so open...🙄🤔🤔🤔

NVC does not approve visas.  The consulate officer does.  I'm not saying there WILL be a problem.  I am saying there might be a lot of extra questions asked. Your choice.  Good luck.

You can use any USC or LPR living in US but i will be honest 

It would be wise if your wife returned to the US and found employment that would have the needed income and health care insurance so she can add u.  she needs to have US income and proof to US residency.

A joint sponsor is not obbligated to support u/  he would be responsible pay back monies to government if u use "means tested government benefits"

 

Just having US wife and joint sponsor does not guarantee a visa

I'm little confused 

Cause it's not obligation for her to be working while trying to get your visa in hand the USCIS giving option by finding a joint sponsor but I do agree if she is working it will make the chances higher 

I'm just concerned about her ex as a sponsor will it be a problem or not thanks

While it is technically allowed, for any US Citizen or Green Card holder actually living in the USA, to act as joint sponsor, the Consular Officer at interview (not NVC) will consider the totality of circumstances in making the public charge portion of their decision.  The petitioner's ex husband acting as joint sponsor would raise a number of questions BEYOND the public charge issue.  My first thought, and the Consular Officer's as well, would be to wonder WHY the ex husband is willing to do this.  Put that together with say, a recent divorce and other factors, raises the question of whether the petitioner's current marriage is all about helping the foreigner get to the USA, instead of being bona fide.  The second big issue it raises, would be whether the ex husband joint sponsor has any motivation to actually provide any support.

 

Joint sponsors who are blood relatives or lifelong friends of the petitioner, are a much better choice.  Don't open a can of worms.

Additionally, it is typical for petitioners to have a plan for sponsorship, BEFORE they marry a foreigner they want to bring to the USA.  A Consular Officer will consider she had a plan to begin with, whether she did or not.  If this was the plan to begin with, it makes it look exactly like a fraud case with all three of you involved in the fraud.  I don't know what the truth is.  I know what a Consular Officer will be thinking the truth MIGHT be.

Responding to what might the officer say about her divorcing the ex it's been 7 years now meeting each other she moved abroad the states and stay with me almost 5 years now we spent 3 years before we got married and waited 2 years before we filled for visa 

I mean if it was just for that things would look happened faster and there is no set up 

But yes I agreed an ex doesn't seem like a friend or family blood , but I'm convinced with what you said thank you again.

Your time living together would trump any of the bona fide relationship or fraud concerns.  Still better, if possible, to find a sponsor with a more plausible reason to act as sponsor.
