Can i divorce and cancel cr1 petition and then file k1 visa for same person? Cr1 is taking two years , k1 can be approved in months.

K1 visas are being spproved in months vs two years for cr1 visa in manila.

 

can i jist get divorced and file for k- for same person?

 

I would rather do aos in the usa for wife once we remarry.

 

has anyone dine this? Please direct me to their profile or link

Umm, they're not. Once you pass the USCIS, it needs to make it to the US embassy and those are not quick given the backlog of cases they're working on. Stay the course as it's cheaper and definitely a better option as green card and ability to work from the moment she steps into the country through POE. 

 

And what's your consulate that you say people are flying through with fast processing? AKA - complete your profile on VJ.

i feel like USCIS would see this as borderline fraud.

no part of the immigration process is quick.

everyones process is different, you would be putting yourself in a bad position if you attempted this.

Three positive things about CR1 are:

 

1) It's much much cheaper than K1 route

2) Once your spouse gets immigrant visa and enter the US - they're LPRs. No need to wait for over a year for GC and be restricted in working, travelling etc like you are with AOS after K1

3) If you're married for over 2 years when spouse enters the US, no need to file I-751 which is additional expense and 2-3 year wait.

 

What you're proposing isn't going to work realistically. You're stuck with CR1, and it's the superior route anyways.

I see tha k1 visas are being approved on average 3-4 months and appooinntments are fast after approval. It is more expensive to travel to phillpimes 1-2 per year during the rwo years wait than to pay for the adjustment of status in the US

Approved in two months, sent to the usb within days, and appointment 3 moo ok mths after. From application to visa interview within a year..

 

with cr 1 i have to spent 8k traveling to pbillpines 1-2 per year, plus separation,

as the person above said, divorce in the Philippines is not possible. 

 

even if you did file for divorce in the United States, I truly think USCIS would notice that you are filing an I-129f for the same person you just divorced and just outright deny the petition. Trying to circumvent the immigration process in any capacity (even if both ways you are trying are legal ways) could be seen as highly suspect or even fraud.

 

i understand your frustration with how long the process is.

But trying to start the process over? with even more complicated circumstances? is going to cost you even more time, money, and energy than just continuing to wait for the CR1.

Regardless of the stats you're quoting, people have already given you the answer: it is questionable at best as to whether this would work. Furthermore, CR-1 is generally superior, so you aren't in too bad a spot.

I would bet a month's pay that this would, at the very least, result in an RFE from USCIS which will add months to the processing time. I also think that the RFE would be attached with a Notice of Intent to Deny which is not a place you want to be.... Believe me I get it. Our K-1 case just took a year and it sucks but don't take what would be a solid, straightforward case (CR-1/IR-1) and turn it into a complicated, messy K-1. You do not want to be on USCIS's radar for suspicions of anything
