Family & Marriage Based US Visa Immigration Discussion

Hi every one

I got my permanent residence card (green card) in 2012 and got married in my country in 2013. Due to the fact that I was not be in the US for six months every year for the next 10 years, I could not apply for citizenship, so I renewed my green card in 2022.  It is worth to mention that once in 2015, I applied for a marriage visa (i-130) for my wife and stepdaughter but I could not be in US for that period of time, so although the marriage visa application was approved, it was invalidated over time. Now that after 12 years I want to apply for a marriage visa for my wife and stepdaughter to live with me in the US, but I found out that one of the conditions for applying for a marriage visa is that "spouses must not be outside the US for more than 2 years” but I have been outside the US for more than two years, so I cannot apply for an alien marriage visa.

If I understood correctly, please guide me how to bring my wife and adopted daughter to US?

Where do you live now?

Visa for spouses and step children have the exclusive purpose of uniting families in the USA.  Until you live in the USA and qualify through the whole process taking 18 to 24 months, there will not be a viable path to these immigrant visas.

As said above, best thing would be to get your citizenship then apply. If you apply as a green card holder (when you are eligible) then it will take many years longer than if you petitioned them as a citizen.

How much time have you actually spent in the US since you became a permanent resident?

You seem to be playing fast and loose with you status, will you now be back for good?
