Question about period of time to submit I-130 (SPLIT)

Kind of unrelated to the topic at hand, apologies for changing the subject, but could I ask you to elaborate on "keeping your I-130 petition in stasis indefinitely"? Is there no set period within which you have to submit your immigrant visa application after your I-130 petition is approved?

 

My spouse and I are currently living abroad and are unsure of when exactly we will relocate to the U.S. I haven't filed our I-130 yet for this reason, on the assumption that we would need to be ready to relocate ~2 years from when we file. Do you mean that we could take some time before proceeding with the NVC stage once the I-130 is approved?

After the I130 is approved, it moves to NVC where you as the USC will be asked to upload documents and the I864 before NVC routes it to the proper consulate.  An I130 petition can sit at NVC indefinitely waiting for the USC to upload the documents as long as you access the case at least once in 12 months.  This is very common for couples that have multiple I130s in place for say a spouse and multiple children.  The I130s may not all proceed at the same pace, so when the first I130 hits NVC, you can let it sit until the others catch up so they can be combined at the consulate phase.

 

Alternatively, if you think you as the USC will see an immediate repatriation in the future, you may want to hold off on the I130 filing.  If you needed to relocate quickly for work, or other reasons, you may be able to file the I130 directly with the consulate (DCF).  If you already submit an I130 with USCIS, the DCF possibility is no longer an option.
