Two children but only one issued a K2 visa

It is perhaps easy to under-estimate the significance of the medical, K1 and K2 visa applicants are required to undergo. Because of a mental health issued suffered by one of my children in the last 12 months, she is being denied a K2 visa. Our house has been sold and the removal men will be here imminently so at least one child will be allowed to attend school in the US. The Embassy staff weren't alive to the problems of forcing one child to stay behind in the UK. Until the left behind child gets the all clear from the Visa Medical centre, she will be without a family and support network she needs.

How old is she, presumably you knew there were issues?

17. So if you have an autistic child or one suffering from mental challenges, they will be refused a K2 visa.

Not sure if I have seen autistic refused and in the vast majority of mental cases they seem to be approved. London seems to see a lot of self harm.

I am no Doctor, I know there can be a very wide range of conditions covered by these terms.

Did they require more medical documentation?

I am seeing the GP of the daughter refused a K2 visa tomorrow in the hope they can say something constructive. So far, this particular GP has written a series of negative letters (to the visa doctor). The visa doctor explained to me that US gun laws were such that they wouldn't allow one of my children to enter (the US). BTW, neither of my children has handled a gun.

“The embassy staff weren’t alive to the fact…..”.   Not even sure what that means, but their job is to issue visas per the law.

it wasn’t smart to make the choice to sell up before having all of the visas in hand.

Nothing to do with a gun, but it does sound like there needs to be clarification, probably from her Specialist not GP

There are health inadmissibilities, which is the reason all k/Immigrant applicants must have a medical exam.

My son has autism, it was documented in the medical report with the comment ('unlikely to gain employment' - what a jacka** that doctor was), and there were no issues.  I really don't think the autism is the issue.

My daughter refused her K2 has 11 GCSEs and is expected to achieve 3 x A'levels all at grade "A". I explained this to the Embassy staff but they weren't impressed by that argument.

It’s not a matter of education or aptitude.   It’s whether the visa applicant may be a danger to herself or others.

I agree 100%. I read the law verbatim and accept what you say is the legal position.

The purpose of making my post is simply to make others aware of the risk associated with the medical process and how easy it is to overlook the dangers of securing K2 visa for your children.
