Can I apply work visa J1 visa?

Timeline

Hi, I'm married with American citizen in Indonesia and I'm Indonesian.  

My husband is sick he is not  able to work or stay in my country so now we have to live in different country.

My question is :

Can I apply J1 visa or work visa in the U.S. while my status is married with American citizen ? But we havent applied any spouse visa yet because my husband is sick and not working so he cant be my sponsor yet .

I cant live away too long from him.

You can "apply" for anything, but do not expect to have such a visa granted, in this circumstance.

The fact your closest relative, your husband, is a US Citizen is clear indication you have immigrant intent.  And, of course you DO have immigrant intent.  That intent will disqualify you for a J1 visa.  You would be using it as a way to circumvent the spouse visa process.  A better route would be to find a qualified joint sponsor, and follow the spouse visa path.  Does your husband have close family in the USA?

Your husband will have to find a way to solve the financial sponsorship issue. He can ask a US citizen or lawful permanent resident friend or a relative to be a joint sponsor. You can’t use a non-immigrant visa to bypass the proper spousal visa process since your main objective is to reunite and live with your spouse in the US.

I would go with a company transfer,, L Visa, much the quickest and easiest.

I have not seen anything in this thread that indicates she has the qualifications for an L1 visa, basically —

  • working for a company with a US branch;
  • working at that company at least one year out of the past three years;
  • working in an executive, managerial, or specialized knowledge position.
