Hello!

We applied for our K1 on 2021, we were approved January of last year and was able to schedule an interview.  However, because of my now husband's mother's medical problems (hospitalized/ICU), we decided to cancel the visa.  I (USC) emailed the embassy to cancel the interview and provided the reasons.  

We decided to marry instead and got married last year.  We just submitted our I-130 this month (online).

My question is, do we still need to submit a written letter to cancel the K1 visa application, that was approved last year?  

I'm concerned that this might give us some issues with our I-130 application.

From what I understand of your dates, you didn't attend an interview that was scheduled over 1.5 years ago and already contacted them back then to inform them of your change of circumstances. It doesn't sound like there's much to cancel.

 

Plus, marriage voids any K1 application. By submitting an I-130 (and providing evidence of your marriage), you have voided it anyway.

 

I would say there's no need to formally withdraw anything. Just let the K1 expire (if it hasn't already done-so).

 

My question to you is why did you wait 8+ months to file the I-130?

I kinda felt like I wanted to get more evidence that the marriage is bonafide.  Although, I had a initial consultation (only) with a lawyer, she gave me a tip to add our approved K1 application, which gave me an idea that, they think that our relationship is bonafide.

At this point, there is no need to withdraw the I-129F petition, as you've already informed the Consulate you will not pursue a visa based on the approved petition.  The petition approval already expired four months after the approval date.
