Received Intent to Revoke Notice After USA Visa Approval

Hi Folks,

 

My girlfriend received an "Intent to Revoke" notice via email today, and we are very tense. She was granted a 10-year visa from the Barbados embassy, so we are confused and shocked by this development. The email mentioned she is being given a chance for a second interview. We are eager to understand what might have caused her visa to be reconsidered seven months after approval.

She is extremely disheartened by this and wants to know how to prepare for the interview. Eventually, we are planning to get married here when she visits. During her initial interview, she mentioned she would be visiting for sightseeing and shopping only. Currently, she is working as a healthcare worker in the BVI and has been for the past three years.

What should we prepare for? Should we be open with the consulate about our intentions to get married, or hold off on that information for now? We are uncertain about the grounds for her visa revocation.

Does she plan to go back after getting married?  If her intent is to stay after marriage and file for adjustment of status, that is visa fraud since B2s are for visiting only.  This could be the reason for the revocation and if so, it may not be possible to overcome during the interview if she is completely honest, which is always the best.  She should never lie to or mislead a consular officer.  You should prepare with a backup plan to get married outside the US if her B2 visa is not approved/reinstated and then file for a proper immigration visa for her as your spouse (CR-1, file an I-130, takes 1-2 years).

Nobody here is going to recommend that you lie about or omit any information that's extremely relevant to your circumstances.

 

If she travels on a B2 intending to marry you while in the US, that's visa fraud.

It's not fraud to intend to get married on a B2. It's fraud to use a B2 with the intent to marry and adjust status.

 

Edit: It is fraudulent to lie about the reason for obtaining a B2, though.

No one here will recommend you lie to consular staff, ever.   
 

If you plan to marry and bring her here to live, she needs an immigrant visa.   If the plan was to game the system and do that on a B visa, then it was rightly revoked.

First off, really sorry to hear that. Hopefully you'll be able sort things out.

In general, you're not required to volunteer information to anyone. However, based on the only in the above sentence and what you have mentioned it seems like she didn't tell the truth about her situation during her initial interview.

 

I'd probably do the following if I were in her shoes:

1. Go to the interview and answer every question truthfully.

2. Be prepared that her Visa will most likely get revoked.

3. Start making plans for spousal visa applications.

 

Hope you guys will be able to figure things out and for a happy ending.

 

PS: Assume that immigration officials have access to all your social media etc. even if it isn't publicly available. The U.S. Government has pretty much access to anything that's online these days. Keep that in mind during your interview.
