Help! What do I do now?

My Immigrant F22 visa has been approved since April 2021 and an interview has been scheduled for Sept 2024, in Lagos, Nigeria (interview appointment letter sent on Jul 2024)

 

At the start of my case in December 2015, I, the principal applicant was unmarried, under 21, did not have a child and the petitioner (my mother) was a green card holder

 

Now, my petitioner is a citizen. I, the applicant, 29, married (February 2021) and have a child as (April 2024)

 

What course of action should I follow?

1. Should I go ahead and attend my scheduled interview?
2. Should I change my visa status? If yes, what procedures should I follow?
3. Can a status change and update be adjusted and expedited to keep my visa interview date?

Depends when you got married (month/year), when your mother became a citizen (month/year). If you got married before your mother became a USC, that petition is dead.

When did your mother become a citizen? Have you informed NVC of your marriage?

She became a citizen in June 2022. 

At the time my case was approved but was awaiting an interview date.

After the birth of my child, I submitted my marriage certificate and other documents to my ceac portal but they have not been reviewed or approved by nvc

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You’re no longer eligible for that visa.   Your mother can submit a new petition for married child of USC.

Sounds like the petition died as soon as you got married. Your mother will have to petition for you again and start from scratch, but on the plus side this means your husband and child can be included. 

 

She was supposed to contact NVC and tell them of the change to your status.
