Married to a US citizen tourist visa

I'd like for my wife to visit the US. We live in Indonesia and we currently have a cr-1 in process. However we don't plan to live there (in the US) and we still have quite a while to wait before the cr-1 is approved. 

 

I'd like to return for a short visit with her in November and am wondering if I should pull the cr-1 since we don't plan to live there and file for a visitor visa.

 

I'm clueless about what to do and would appreciate any advice.

I would not pull the current I130 as you are able to keep it is stasis indefinitely once it reaches the NVC stage until your plans become solid.  She can also try for a B2 application that may or may not be approved.

I think that, with a CR1 already in play, you cancelling it and trying for a B2 could be seen as an attempt to circumvent the CR1 wait times.  That is, she enters as a tourist and you adjust.

 

Based on what you've said, that's not the plan, but being able to clearly articulate her ties to Indonesia will be important.

Hopefully you realize that "pulling" a petition doesn't erase it from the record.  

 

Her abilty to get a B visa is entire based on her strong ties to home, which is a bit of a stretch with demonstrated immigrant intent.

Plus one has to declare any immigrant petitions in DS-160 that were ever filed.
