Hello everyone, I hope you are doing well.

 

I would like to ask and reconfirm about the AoS form. So, we got our marriage certificate, proof of the photos of our wedding, I just had a medical exam test last week, and my husband just added me to his bank account. The questions are:

  • We are still working on I-130, I-485, I-693, and I-684 forms. All of these are correct to fill out the AoS paperwork? If not, please enlighten me.
  • If all of those are correct, do we need to send all of the documents at once OR we can fill out the I-130 online first, once got approved we can send all of the rest of the documents at once?
  • Do I need to apply I-765 also?

 

Another thing, we live in Alabama.

How do I know that we need to fill out the I-130 form? Because on the USCIS website says that "Most people who apply for a Green Card will need to complete at least two forms—an immigrant petition and a Green Card application". One of them is the I-130 form, so I just assume we need to fill out that form beside the I-485 form.

If you entered the US via a K-1, you do not need to submit an I-130 if you married the petitioner within 90 days of arrival.  Perhaps studying the VJ guides for adjustment of status will help.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Did you get married within 90 days of your K-1 entry?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Then you dinr need I-130 as also mentioned by @Crazy Cat

Okay, so we assume that we just submit 485, 693, and 684? Send all of those files at once? Is that correct?

I693 and another medical is likely not required for K1s either if you 1. COMPLETED your medical abroad AND 2. are filing I485 within one year of the date of that medical AND 3. your DS 3025 is MARKED complete AND IS complete. 

 

Read through the I693 Instructions before spending money on another medical.
