N-400 Interview - Pls I Need help!

I went for my n 400 neutralization interview last week, passed all the case however I was handle a paper for a decision cannot be made for your application.

 

The officer told me at the end of the interview I just have to upload the scheduled payment paper we have for IRS for what we owed in 2021 I should be good, on getting home I saw some  list of RFE I have to submit like bills,proof of we still married and live together, taxes which I had submitted before I was scheduled for my interview.

 

 

I notice something was a little bit off with the officer, she was like in and out complaining about some computer stuff on her end which ain't got nothing to do with me. ( oops I told myself I got the wrong one😒

 

I got my GC through a US citizen in 2019 (April) which we're still married, No kids, No joint bank account, no properties on our names, we still live in same apartment she had before I got here while we saving up, We got car insurance together for 5 years, my wife adopted my last name from the day we got married and we filed taxes together until 2023 became a 1099 filer.

 

My Question is IO mistaking my case for 3 years GC rule? Or it's just a new things going on? Do I need to get a lawyer?

I hope you were actually going for naturalisation not neutralisation !! 🤪 Please post a photo of the actual paperwork you were given with personal details redacted. It helps us to give the best answer if we can see the paperwork.

What I understood from your case was you owed IRS in this year 2021 which you have to pay before a conclusion will be finalize in your case according to the officer. 

However, try to understand if only you own IRS even a dollar, you can't get through with your N-400 Naturalization for Citizenship. Pay the IRS Bills and you will be fine.

On your copy of the N-400, did you select 1.A. (five years as an LPR) or 1.B. (spouse of U.S. Citizen)?  If you selected 1.A. and the interviewing officer treated it as 1.B., I guess you have an argument that it was handled incorrectly.  They are supposed to handle it as you requested on the form.  You can make the argument that the IO made a mistake and should have reviewed just your information.

 

But the IO has reviewed it and issued an RFE.  It might be better to go ahead and respond to the RFE.  Asking for the documentation that indicates your U.S. citizen spouse paid their taxes or entered into an agreement to pay their taxes doesn't seem like a big deal.

 

She might have screwed up.  But if you respond to the RFE successfully and naturalize, how you got there won't matter.  I'll suggest it's better to go with the flow and get it done.  You will be so much happier when these people are in your past.

I hope @Nashmusah was actually going for naturalization (naturalisation is UK / Australia business).

 

Looks like OP's case was treated as case under 3 year rule.

 

What boxes are checked on your form @Nashmusah?

Regarding marrage proof since u already approved for GC on marrage based visa should not be a big issue . But looks like its tge interviewing officer who determines that your marrage is still valid and ir together . So routinely requested that proof aswell

Not true, you can still become a citizen even if you owe back taxes. You just need to show USCIS your payment plan with IRS, which is what the IO asked for. Perfectly normal, they ask this of anyone who owes taxes from previous years, to make sure they're doing what they can in order to pay it off.

I got this at the time for my citizenship which the officer told me,  and in addition my friend goes through the same route on his naturalization for citizenship.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
