Beneficiary's kids marital status

Timeline

My uncle (us citizen) had petitioned for my Mom and according to the rules I've read it says that the beneficiary can take along their spouse and unmarried kids. I've been married and divorced so am I still eligible? The legal documents that were changed were only my NIC card and not my passport. Also what should I do moving forward to be able to tag along my mom? Any advice

When was the petition filed?   Sibling visas take 25 years or so.

2010 but they are processing application from 2008 right now according to visa bulletin

Those that applied in 2008 still aren't eligible for visas though, the date on Table A is August 2007, so maybe 4 or 5 years before your mother gets her visa?

 

If you have aged out (or will age out), then another option is for your mother to petition for you once she's got her GC and is living in the US. That'll be another decade or so from when she applies, but is at least a solid Plan B.
