I tend to agree for the future.  Too bad USCIS/DoS does not have an automatic conversion of a GC to a B2 with a valid and processed I407.

I have not come across someone being taken into custody especially in this sort of case

 

I could see a trip to secondary and some heavy questioning

 

Not sure about IJ, after all her child could just opetition her again so what would be the point.

Not sure about IJ, after all her child could just opetition her again so what would be the point.

A bigger picture thought is that it may well work once but not a second time unless she spends significant time in the US .. so it is not really a long term solution

I second the thought of getting on a plane and coming back.  If there are questions, answer them truthfully, but there is no obligation to give CBP any additional information.

Then fly to Cnaada and walk through border. This has been done, even by those with years absence. 

 

If they deny her entry, IF, she can just walk back to Canada and fly back to Brazil.

Hey guys, just wanted to give an update.

So after reading pretty much everything on the internet about that. We decided to risk it, and my mom came on a flight on Friday!

Im not encouraging anybody to do that, because we were all very nervous and not knowing what would happen, but she landed in MIAMI. and CBP questions were: - where are you coming from? - how long did you stay there? ( what she wrongly answered 10 years )....she said CBP looked a little bit disappointed but that was it !....he just gave her back her passport / GC and called the next person waiting on the queue

 

We have no idea what we gonna do about her GC now, but just wanted to share with you guys the update

@brzfromfl we tild you so. 

 

Nothing you can do about her GC. She can't apply for citizenship because she broke her continous stay. Her GC is still valid. Nobody will bother her about anything. 

 

What we all here would suggest is for her to stay put till she's eligible again for N400, apply and be free to travel whatever and not be stuck in this same situation. 

 

Thanks for the update. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.
