I am reaching out in hopes of obtaining guidance or information regarding a humanitarian reinstatement or reaffirmation of an immigration petition due to the death of my petitioner. My case is currently at the NVC, and the embassy involved is in Islamabad, Pakistan. I am residing in the USA and am in urgent need of advice or information on how to proceed, as well as recommendations for any lawyers who specialize in this area. Any assistance or insight you could provide based on your experience with a similar situation would be immensely appreciated

If the petitioner has died, the beneficiary must find another US citizen or permanent resident who can meet those requirements. The substitute sponsor must complete and submit an affidavit of support by filing out Form I-864, showing that their income is enough to support their household and the sponsored immigrant.

What type of petition is your case?

My Petition is I-130 Category F1 Petition got approved After 4 months death of Petitioner I was overseas in Pakistan at the time of my father's death.

 

 

When was the I-130 applied?

When did your father die? 

When did you enter US? 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Petition Filled in November 2017 

Left  USA IN 2019

Petitioner my father passed in 2020

Petition approved in 2021

Case transferred to NVC

Entry again USA 2024

I am waiting for a U visa to ve available Inside the USA. I got parole to reach in April 2024 on behalf of U-VISA.

My Petition is an I-130 Category F1 Petition that was approved After 6 months of death of the Petitioner I was overseas in Pakistan at the time of my father's death.

From my reading, you don’t seem to qualify for this petition to continue - https://www.uscis.gov/green-card/eligibilitysection204lreliefsurvivingrelatives

 

But I would absolutely speak to a lawyer to see if there’s any chance. Good luck.
