Does this crime fall under AWA? Here are the details of the conviction and what we'll provide USCIS for the RFE

Because I am waiting for the decisions on the i485 and i130 - I need to be able to stay here... I am not a USC, I'm a beneficiary...

I hope that now it makes sense why I asked if his conviction likely falls under the AWA. 

 

You probably didn't get to read the screenshot I attached of the RFE from the i130 he submitted for me, but we're trying to gather said documents to plead our case.

 

Please let me know if I can clarify anything else for you, I did write a wall of text and I understand it's a lot of digest.

The conviction  does fall under AWA . Look at the specified activities in link below and you will see it listed in the denial .

 

You seem to have been caught unprepared…but it is what it is. 
‘Just showing court records and trying to explain it away…will not work. 


 

You needed a forensic psychological evaluation and a long list of evidence that proves he is no risk. 
 

Don’t waste your time making argument that he was innocent or that case/trial was procedurally defective, it won’t help you at all. 
 

If you are still making payments on appellate attorney retainer, ask him nicely if he can hit pause for a bit. You absolutely need an attorney that knows AWA …to have a shot at getting a No Risk Determination.
