New Relationship Started before the previous marriage officially ended. K1- Visa

Hi guys, my fiancé’s K1 interview is coming up. We’ve noticed a red flag, and I don’t know what to do at this point. I’ll share the time line. 

 

- I was separated with my ex husband around July 2019, however, there was no legal document for this separation. Divorce request were submitted in the early 2020. 

- I met my fiancé on the internet in December of 2020. 

- I met my fiancé in June of 2023 for the first time. 

- The final divorce decree came in Oct 2023 due to COVID, a lot of cases were waiting to be processed.

- Petition filed in December 2023. 

 

So according to the time line, I met my fiancé before the previous marriage officially ended. Will this affect his visa? How should I address this to the CO? 

 

The reason for the previous marriage to end was because my ex-husband was barely home, and never took responsibility. We also have a baby together, he grew abusive towards the baby, I found out when our baby was 2 years old. He spanked the baby’s butt till purple dots and bruises appeared. I kicked him out of the house and refused to have him stay with our baby alone.

If asked just tell them the truth :)

 

Officers are more concerned with background checks, ensuring the relationship is bonafide, that both parties are legally able and willing to marry, and making sure the foreign spouse will not become a public charge.

Timeline

My husband was still married when we met, although he had not seen his wife in decades. They just never bothered to divorce. He got the divorce and we sent in the I-129F. It wasn't a problem at all. No one ever even mentioned it.
