In 2007 I filed the I-129F for my Fiancé  She came to the US and we got married.  14 years later we got a divorce. Then I found love again and filed the I-129F to bring my new Fiancé.  NOA1 date was August 16 2023. We broke up in November. I went back to her home country in January to try and fix it however I made it worse,  I sent a request to withdraw the case on February 14 2024 however it was approved NOA2 on February 29th. I then sent a withdrawal notice to the NVC and they sent my potation back the the USCIS to expire. I now am working on filing again.

Item Numbers 5.a. - 5.d. Multiple Filer Waiver Request. You must request a waiver of the International Marriage Broker Regulation Act (IMBRA) filing limitations if: 1. You are filing this petition on behalf of your fiancé(e) and you previously filed Form I-129Fs on behalf of two or more fiancé(e) beneficiaries; or

You are filing this petition on behalf of your fiancé(e), you have previously had a Form I-129F approved, and less than two years have passed since the filing date of your previously approved petition

So it looks like in order to file another K1 application I will need to file for the waver with my I-129F application.  Does anyone know how successful that is or how long it takes?  I am thinking about going back and Marring her so It won't matter. Any suggestions or knowledge would be suggestions.

You are filing for Number 2 again?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

No number 3.  I think I have decided to do a CR1 even though it takes longer then the  I-129F for a K3 knowing it probably won’t matter

Good luck you didn't do a CR-1 for number 2.  Do you really want to take the same risk again? Only you can judge that.

I actually forgot about an old K-1 that I did way too fast, and let expire at the embassy level. Therefore, when I applied for my K-1 for my new Wife that, this time I dated for 6 years before plunging in, I got an RFE .,. They requested a multiple filing waiver,

After only about 4 days after they received it, they approved my K-1.

The bottom line is that if you are not trying to commit immigration fraud, or abusing the women, human trafficking, etc .. then you should not have an issue getting the waiver immediately approved with your K-1.  You just need to explain what happened, and prove your new relationship is real and sincere
