US citizen married Mexican citizen, living in Mexico. Hopeful for CR1-IR1 process advice

Hello everyone at Visa Journey,

 

I am a US citizen living abroad in Mexico. I married my husband (Mexican citizen) here in Mexico, March 2024. I have my temporary resident visa for Mexico and we are hopeful to start the process for the CR/IR visa for my husband. 

 

I am looking for advice and guidance if anyone else has been in this situation, married and living abroad. We are hoping to discover if it is recommended to go through the consulate here in Mexico, or if we should travel to the US to file and complete paperwork. 

 

I also understand we will need to fill out the I-864 Affidavit of Support. I am currently unemployed :( but I see we can have a sponsor also sign. Does anyone have experience with this as well?

Start by clicking on the word "Guides" at the top of any page here.  No, you cannot complete the process with both of you in the USA.  It's going to take a couple years or more going through Cuidad Juarez, but you have no other legal option.  You will either need to go back to work in the USA to qualify as sponsor, or find a well qualified joint sponsor with a plausible motivation to support the two of you, if you are not supporting yourselves.

I filed for my husband's i-130 a year ago while living in mexico with him, but i had a wfh job that was enough  sponsor him.  In the initial application we sent proof of living together in Mexico  and I put that I worked making usd.. I recently moved back to the USA after living in mexico for 2.5 years.. i got a new job and a place. Just waiting for him to join me.. thinking we have to wait another year or so since we got our i130 approved like a week ago.

Yes, the wait for an interview in Cuidad Juarez is around a year or more.
