Hi everyone. 

I applied for an adjustment of status back in may and got an RFE yesterday. They are asking for the most recent tax returns (2023), however our joint sponsor has filed an extension till October and cannot do taxes before that. 

We made sure to include his 2022 tax return transcripts and a letter from his accountant stating that he filed for an extension with a submission id and all. 

 

I am attaching the rfe (personal info redacted). 

 

My question is, should we send the actual 2022 tax returns (not the transcript) along with the 1099s/w2s and paystubs for the last 6 months, or should we look for a different joint sponsor and send a new i-864 with the requested info?

You'll need to have them either file all three or get a different sponsor.

 

Only the most recent is required, the previous 2 years are optional (according to instructions of form I-485)
