CR1 is already in NVC and just Receive NOA2 of K3

Hi Guys,

Hope u can give me advise with regard to our case. They said that K3 now is much more expensive than CR1. My husband file the K3 just last Jan 07. Then we just received NOA2 yesterday (aug 7, 07). Our CR1 now is already in NVC and we are waiting for the IV Bill fee then DS230 before it will be completed in NVC.

My question is it really costly now if you will proceed to K3 application? And what is normally the processing time after u received NOA 2 in K3 to the time NVC will complete the case? In our case since we already submitted the DS3032 and the I-864 in NVC in our CR1. Is this means that we can skip the process for filling the DS3032 and I864 in our K3 application since we already done this in our CR1 or do we need to submit another same document for K3?

And what do you think is the best visa for us the K3 or the CR1 since we are almost done with our CR1. And i heard that K3 now is much more expensive because of the AOS.

I would say that you stick with the CR1 since u have already reached so far. Its a better visa obviously. reading other posts I have learned that K-3 will move along so just let it be, and hopefully your CR1 will win the race.

Hi! Congrats on being so close! As you can see from our timeline below, we had kind of similar experience. We decided to fork out the money and move ahead with both to see which would come sooner. Of course if at all possible stick with the CR1. You will be super happy you did. The only reason we would have done the K3 is if the CR1 would have taken a few months longer. Otherwise, the CR1 is well worth the wait.

On another note, we received the K3 interview prior to the CR1 and the interview date was 2 weeks prior to that of the CR1. When we went to the embassy in Manila for the K3, I requested that they interview us for the CR1 instead and they had absolutely no problem doing that Yay! So it just depends on how you want to move and if it's worth the money or not. But you should stick with the CR1 if at all possible, (unless it's going to be a really long time) you will be so glad you did I hope this helps! Take care!

With the K3 you are facing 1010$ AOS fee, and you still need to adjust the status once in the US, while with CR1 you already have the green card and everything. How long it takes it's impossible to say, it depends on the name checks that NVC runs.

Personally being so far in the CR1 process I would stick with it, although now there is not much you can do, just go ahead with the process and than take whatever is there first. You are 380$ away from the CR1 visa.

I just don't understand why the CR1 visa has such a negative rep. In most cases the only difference between the two visas is about 1-2 months tops and yet people think that they will save 6 months if they file for a K3.

Stick with the CR-1, since you had already submitted the I-864 it will only take about 2 weeks to receive the IV fee bills and then the DS-230 forms. After submission of those forms and the documents that should go with it, then NVC will forward it to USEM for the interview.

Getting here in the US on a CR-1 visa is a much better option since this is an "Immigrant Visa". You will only need to wait 2-4 weeks and you will receive your GC then you only need to wait 21 months to file to Remove Conditions (I-751). No need to apply for EAD and AOS.

With K-3 -> once you get here, you will have to adjust status (AOS=$1010) and that could take months before you can receive your GC and would be eligible to work. Some would even have to apply for EAD (work permit) because AOS takes too long and they want to get a job.

But for sure with ur advises here with ur i will rather want the CR1.

We are in the same situation, with an IR-1 almost done at the NVC and now with an approved I-129F petition. At this stage, however, there is no point any longer to pursue the K3 since both IR-1 and K3 will end up at the Frankfurt Consulate practically at the same time.

Hi hhk3, yes ur right we are almost the same situation but good for you since you just apply last March 2007 and you almost done.. Not good for us since we filed last July of 2006 and yet until now we are still apart but at least its moving now..

Even though our journey has been relatively fast compared to yours, I still cannot get over the fact how cruel and disruptive this visa process is in general, putting people's lives on hold for long periods of time, sometimes very long periods of time. Seems a far cry from "Give me your tired, your poor, your huddled masses yearning to breathe free..."
