RFE..HELP US APRIL FILERS..

Dear fellow April filers..

Jessel Chris and I (kits and faith) both have NOA1s dated April 12. I'm a March filer and Jessel is an April filer. We both were so excited that our time is so near to get our NOA2. Both of us got touched August 8 and both got an RFE instead of the NOA2. The only positive we get our of this is that they haven't forgotten us, but why need evidnce if they are going to approve it anyway once they get what they asked for and I heard sometimes they ask for something you arleady included when you submitted the application. Is this like an insult or just becase they CAN DO THIS TO US? I mean if the office is having a bad day or let's say have prejudice in certain countries.. I'm sure they can punish us by making us wait longer.

Once we have sent the RFEs and once they have received it, can anyone here ASSURE US THAT IT WILL NOT TAKE MONTHS AGAIN TO GET OUR NOA2? OR WILL IT JUST TAKE A WEEK OR TWO TO GET NOA2 ONCE THEY GET THE RFES? THANK YOU AND I HOPE YOU GUYS UNDERSTAND US..ESPECIALLY THOSE WHO NEVER GOT RFES AND HAVE GOTTEN NOA2S.. WE ENVY YOU AND WE ARE SORRY FOR THIS..

You haven't even received the RFE yet, so you don't know what they are looking for. Maybe it was a mistake on the forms, maybe they will request more evidence...until you actually get it, you won't know how to proceed.

Kits, i'm sorry to hear you guys got an RFE, also Jessel and Chris. I'm positive though that it won't take long for an approval once they receive back the RFE. I've seen several people here who got approved immediately or after a week after sending the RFE.

I'll be praying that both of you won't have to wait any longer than a few weeks! Good luck!

I love her so much.. but it's all my fault.. I put her through this.. why does it have to be a complicated process.. compare to other types of petitions.. i do hope it's just something easy so i can send it back asap.. and i do hope that we will get our noa2 faster after receiving the rfes

hi kits. im so sorry to hear about your news. my fiance is also a filipino who got naturalized there in the US.

i guess, for your case, they are "maybe" asking for evidences of your US citizenship.

when we submitted our petition application for the evidences of his US citizenship, we submitted his original birth certificate here in the PH, photocopy of all pages of his passport and photocopy of his certificate of citizenship together with form FC-029 (for submission of the photocopy of original docs). did you also submit these docs?

but until now, we are stil waiting for our noa2 from csc.

i suggest, you call uscis using the rfe trick and ask immediately for the details on your rfe.

kits_24_faith are we still going to hope??? the officer who got our papers really sucks! tell faith to be strong and keep on praying. I stopped my self not to cry anymore......

Good luck to you guys! Im sure it will be something simple that you can get resolved quick. From what I have read in other places on VJ, after they receive your RFE reply you'll get NOA2 fast.

I'm not as religious as my girl, but one thing I kept telling her was that God was testing us to make sure, that if we can make it through this process, we are good for life :)

An RFE is by no means the end of the world. As some have said, it may sometimes even be for something already submitted, and usually it is for something easy to provide. Go through your copy of the petition that you made for your records, and see exactly what you sent in for birth certificates etc. Some people have been asked a number of things in an RFE and the RFE's themselves are pretty much scripted in what they are asking for.

Over the 8 months or so that I have been a member of VJ I have read of many reasons for the RFE's being sent. I also have seen from timeline information that most RFE responses are acted on very fast once they receive the information they are requesting. The denial rate of I-129F petitions from member accounts are very, very few. If you meet the basic criteria of being a USC, Having met one (1) time in the past 2 years, and are legally able to marry, you should be approved. With that in mind, review your petition and look for any weak links.

Denials come more from Embassy interviews and dealing with the Dept. of State not at the first step of petition submission and approval.

Thanks for the information.. I am currently just waiting for the letter to arrive. By the way, does anyone here have an idea how think it would be? Will it be just one sheet of paper with the list of what they need? I hope it will be very little and very easy to provide and won't take much time. So far, I have been searching for folks here that had RFEs and found that they get approved right away, like less than a month. Is there anyone here taking so long to get approved after CSC receiving the RFE? Also, what reasons do you think on the interview they might denied? Kits and Faith, I've never seen so many touches in anyone's timeline signature before. That's incredible. I'm sure your RFE will be an easy fix. And it shouldn't take long. Its like being at the post office. If you need to fill anything out, you simply step aside, instead of going back through the line. You'll be fixed up in no time.

So far, I have been searching for folks here that had RFEs and found that they get approved right away, like less than a month. Is there anyone here taking so long to get approved after CSC receiving the RFE?

Also, what reasons do you think on the interview they might denied? Usually they just reschedule another interview if something is missing or forgot to bring in the interview? What is the percentage of getting denied in the interview? Thank you and sorry for the questions.

regarding the lenght of time your petition should take after the RFE is recieved...it usually goes fairly quickly, provided that the information is accurate and sufficient...here a link to a post from a former immigration officer, and his daily procedures when going through petitions...he says that he tries to clear off all the RFE cases first thing in the morning because they are the older ones...this is just one officer, but i think that because your case has been already assigned to a specific officer, and has also begun to be reviewed, that once you send in the necessary info, it should be a pretty snappy decision

i havent been through an interview as of yet, but i would certainly make sure that your fiance knows ALL of the information that you submitted with your original petition, as well as packet 3...any personal info that is in there...nothing is 100% but you can certainly increase your chances of an approval by answering all of their questions correctly =)

Hey Kit 24 Faith I got an RFE and it took about 17 days to get NO2 after I replied to RFE from VSC a couple of key things here don't speculate on what it could be just be ready with the required documents so you can send it back ASAP I sent mine back same day I received letter of RFE because of a Divorce Document that they wanted. I sent Judgement of Divorce but they Wanted Actual certificate of Divorce I was thinking crazy reasons. So slow down think and wait I know its hard. I also spent 30 days at NVC when it normally takes 3-5. So I understand some of your pain and frustrations. Strange you have so many touches and then the RFE. Hang in there and be strong for her.
