I-130 application status went from two weeks for a decision to 24 months

Hi there,

 

I submitted a I-130 for my spouse in March of this year.  After about two months, the status was changed to 2 weeks for a decision.  After two weeks, it changed to 24 months.  This seems ridiculous.  Do I have any recourse for this unreasonable timeframe?  Can I contact my State representative for help?

Your Senator or Representative cannot expedite the process.  Every case is different.  This is a long, painful process.

state  representative can not help

you can sign a waiver  and they can inquire and the notice will be the same info u get

"case is in process" or similar statement

 

It helps VJ members to best answer queries if u do a timeline,  ID the country , 

hit the word portal above and read posts and embassy reviews from others going thru the same embassy

 

timelines according to USCIS are not reliable and can not be counted on 

they are all over the place

I think you should assume that your petition will take at least 12 months for approval. Definitely disregard the estimates from USCIS.

Ignore the time estimate.. if you upload unsolicited evidence it will update again in a day or two. My case was approved yesterday and it said 4 months.. I checked this morning it said 5 months. It was finally updated this afternoon to case approved.

Ignore what the case tracker says. It is wonky, especially if it tells you 2 weeks if you just filed a couple of months ago. 

 

Right now, they seem to be taking about 11 to 14 months to process I-130's. 

 

They are mostly focused on asylum seekers/ refugee work permits and granting citizenship so they can crank out as many new voters as they can. It's election year after all. 

 

Hopefully after the election is over with USCIS will start prioritizing I-130's.

Simalar happened to me. I look at it as humor by USCIS. Finally approved after 2 years.
