NVC will use the guidelines in effect when they have the case.  The Consular Officer will use the ones current on the interview date.  Those may or may not be the same, but in this case they will most likely be different.  Either way, if you meet one and not the other, that's too close for comfort.

I hear you, too close to comfort.

Hi Chiemi

,

I'm glad you found the suggestions helpful!

To answer your question, you'll need to use the poverty guidelines for the year in which your I-864 is submitted, not the year you submitted your I-130. Since you're likely to submit your I-864 in 2024, you'll have to use the 2024 poverty guidelines, which are indeed $25,550 for a household of two.

It’s great that you're actively working on getting him a US-based job. Every bit of effort helps in strengthening your case. If you can secure that income and provide the necessary documentation, you'll be in a good position to meet the requirements.

Keep pushing forward, and feel free to reach out if you have more questions or need further assistance.

Best of luck!

So it's going to be either the 2024 poverty guideline or the 2025 one depending on the year we submit our I-864.

We thank both of you for clarifying it for us.

No.  The visa decision will be made at the interview, as will the pubic charge issue.  It depends on the date of the interview.  You do not know if that will be the same year you submit your I-864.  The correct answer is the correct answer on its own.  It's not about holding a vote.

I'm sorry to bother you but let me make sure I understood it correctly. So NVC will use the poverty guideline of the year we submit I-864, a CO will use the one of the year the beneficiary has the interview.

We likely (and hopefully) move on to NVC stage around the end of this year.

Do you think it's better for us to wait until 2025 or the reveal of new poverty guideline then submit I-864?

We want to be certain that his income is sufficient.

It's based on the totality of circumstances.  If you're marginal, trying to time a petition submission around the federal poverty guidelines does not make sense.

You're better off seeking a well qualified joint sponsor, or trying to improve your income.

No.  Like I already said, if you meet one and not the next, that's too close for comfort anyway.
