Ok to marry during a visit to USA, return to home country, then file for K3 / CR-1?

I completely agree with this 100%. 

 

Entering on a non-immigrant visa with the intent to stay and file for adjustment of status is fraud and it could get you both in serious trouble.  You can possibly overcome doing that,  but it would be very hard to prove that she did not misrepresent her intentions for entering the country. 

 

Just get married while she's here and have her go back to China and start consular processing.

 

Fire that attorney. 

 

You are definitely going to need an attorney since she's part of CCP. 

 

 Call around to several different attorneys and get their advice. There are quite a few that will give you a free over the phone consultation. Do not hire any attorney that tells you to marry and then adjust status.
