story line

In February we filed your I-129f while waiting for interview we found issues to our petition { long story why}

we canceled our petition in hong kong and requested our folder to be return to us for correction and we would resubmit later

It been in Vermont since May and still don't have it back I have contacted USCIS about a dozen times still don't have it back they really don't what to say they keep telling me to wait ...for what it been canceled

i have sent over night letters to Vermont never got a response i even sent one to the director there still never a response

i even called my local Congressional rep i hope that helps but feel that i might be a waste of time

has anybody else gone threw this ?

Wouldn't it have been easier to just wait for an RFE instead of canceling the petition and having to spend a much greater fee now?? Maybe I'm missing something. If something was wrong with your petition, they would have simply requested more evidence. I hate to say this, but you could have been finished with this long ago. I'm afraid it takes longer to truly cancel a case than it does to fix it. Good luck to you.

16 July 07 - I-129F delivered to VSC and signed for by P. Novak

20 July 07 - NOA1 issued / receipt number assigned

27 Sep 07 - Jason travels to Moscow to be with Sasha for 2 weeks

28 Nov 07 - NOA2 issued...TOUCHED!...then...APPROVED!!!

01 Dec 07 - NVC receives/assigns case #

04 Dec 07 - NVC sends case to U.S. Embassy Moscow

26 Dec 07 - Jason visits Sasha in Russia for the 4th and final time of 2007 :)

22 Feb 08 - Moscow Interview! (APPROVED!!!)..Yay!

24 Mar 08 - Sasha and Jason reunite in the U.S. :)

31 May 08 - Married

29 Dec 08- Alexander is born

11 Jan 10 - AOS / AP / EAD package sent

19 Jan 10 - AOS NOA1 / AP NOA1 / EAD NOA1

08 Feb 10 - AOS case transferred to CSC

16 Mar 10 - AP received

16 Mar 10 - AOS approved

19 Mar 10 - EAD received

22 Mar 10 - GC received

It is highly unlikely you will get the folder back.... you should submit your new petition now and not bother waiting for the old folder... you could have been all done by now if you had let the old petition run and just sent the corrected info...

RFE was not an option we had to cancel correct and resubmit

considering the problem if found during interview she would have been denied entry

tonight i was forward a form for request of return of documentation ill fill it out a see what happens seems like a positive note

I'm not sure about the entire folder, but the center you sent the information to you should be able to return original documents (it seems to follow that they could send back everything, but who knows.)

"In cases where an applicant or a petitioner submits original documents when not required, due to cost involved in returning such documents as a matter of course, USCIS will retain the documents and make them part of the record. In such cases, applicants or petitioners who wish to have their original documents returned to them may submit a written request to the office that originally requested the records." (Italics mine.)

Depending on what the problem was you found, you may have been given a 221 g at the consular interview, asked to correct the issue, and then ultimately given the visa.

Water under the bridge now though.

At any rate, you have cancelled that petition. I find it VERY unlikely that you would get the 'folder' back - and even if you can, it'll probably take more time to get it back than it would just to resubmit and start again. If you made a copy of what you initially sent, that would be very useful now. If not - you're still likely better off to just get going again instead of waiting on their massive red tape to find the old one.
