taxable income

Hello there, i am applying for fiancé visa to bring her to USA but i don't have any taxable income. i have family of 3 and adding her would be 4. I have assets such as house and banks but i don't really know how to calculate that. what are the chances that she would be approved with my assets? i need someone who can help me calculate that please. would anyone be able to help me?

1.  Qualifying income doesn't have to be taxable.  If you have documentable, qualifying income (taxable or not), you can use it. 

2.  Using a primary residence would be difficult.

Taxes are not important unless you are self-employed.  CURRENT annual income is king.

so i talked to a laywer and she said i have to have taxable income or else i have to show assets or have  a co-signer

The attorney is wrong..  What is the source of your income?   "Qualifying" income means documentable and sufficient.

my source of income would be from work, i work at a bank and do homecare after that. last year i didnt had the bank work since i started july of 2023. in my tax return the taxable income was 267 and she said i would need that to be atleast 40k

What is your current annual income now?  Curren annual income is calculated as follows:

 

Gross income from most recent pay period multiplied times the number of pay periods in 12 months = current annual income. Do that for both jobs, then add them. 

For a 4 person household, $40K is not enough for income needed for the I-864 (when applying for Adjustment of Status), imo, since $39K is the I-864p level.

I don't see a problem with your current annual income.  We see inaccurate attorney advice from time to time.  Your question is not unique.  We see this question frequently.

Taxes are irrelevant when calculating current annual income unless you are self-employed. As I said, your question comes up often.  

As an employee, USCIS will use your paystubs to evaluate your ability to support a new immigrant in the future...not what you reported to the IRS over the past 3 years.

Based on a very sufficient annual income, you don't need a joint sponsor, and you don't need to use assets.....I am 100% confident.
