I was married to a US citizen in Brazil in 2012 and I move to US in 2014. I received my permanent resident in 2017 and We divorce in 2018 after 1 year of separation from so much issues. between us  I  later re-married in 2018 and filed for my citizenship in 2019. I was invited for citizenship test in 2021 in Newark NJ which I passed but the interviewer said decision can't be made. I made a change of address after I moved to Maryland and It as been over 4 years but still waiting. I  have also made several calls and also seek help from the Senate here in Maryland but they could not help either. I also filed for my family over 2 years but still no update on theirs too. Although i have travel 4 times, I only spent not more than 3 weeks in each travels. I need advise can someone please on what I can do please help me .

What basis did you file for citizenship?  It appears like the 3 yr rule.

Did you do your filings ( for N-400 and I-130) by yourself or did someone help you? 
Is the family petition for your new wife ?

 

I realize you want answers on what to do next, since both cases are stuck. ..please answer the questions as they will determine your next steps. 
‘You should start by filing for copies of your entire record, called FOIA. It’s free , can be done online and you will need it. Ask for everything related to your I-485, N-400 and I-130 for “family “ member.

I filled the N400 myself but a lawyer filed the i30 for my family.

I just read your profile and story of meeting your first wife in 2012 and marriage. It makes me think you came in to the US as CR-1 ( with green card ) in 2014.

2014 you enter the US …how? A visitor visa?

2017 you get LPR/green card

2018 you divorce and re marry…( the one year of separation is throwing me off….as it looks like you were separated when you got LPR….or day after)

2019 you apply for N-400 ? How Why You did NOT qualify under 3 year rule due to divorce and did not have 5 years.

 

Check the dates you listed in your original post. Are they correct?

In 2019 when you filed N-300 under three years, you did NOT meet the requirements because you were divorced . 
 

So you need to file a new N-400 under 5 year rule

Yes, it sounds like the 2017 green card was from ROC.

What Family and OldUser said. Based on the information you shared, you applied for citizenship under the 3 year rule, which makes me think your green card was a conditional, you don’t mention ever applying for the Removal of Conditions. If all of this is true, withdraw your N400 application immediately and hope they don’t investigate further. The government is doing you a favor: based on what you share it looks like you shouldn’t even be a lawful permanent resident in the first place and you could risk deportation.

Not such a gloomy forecast at all😂. All will be well once he files new N-400 under 5 years. 
‘As @Dashinka pointed out, he likely did ROC and got conditions removed in 2017…so his LPR status is all good

OK, so now the specific dates play a role as if you filed the N400 under the 3 yr rule, it will not go anywhere since you divorced your 1st wife.  If you filed under the 5 yr rule, then you may need some help to get it moving.  Are you certain there are no RFEs, or other notices on your online account.

Excellent. You made a mistake by filing in 2019 for N-400 and they just did not get around to denying. You had to have 3 yrs as LPR and be married at time of filing ….but you were divorced


Solution : new N-400 under 5 year rule
