Bringing my 60 y.o. Mom to United States

Hi all, I am posting this for my very good friend. Trying to help her with bringing her mom to the US.

She is a 29 y.o., she was born United States, and grew up in Mexico. Currently she lives in Los Angeles, and she is fully a US citizen with a passport.

Her mom is a Mexico national, with a tourist visa into the US at the moment.

My friend wants to sponsor her mom in order to bring her to the US. To my understanding that is a for I-130, correct ?

Also, I see some information online that I-485 can be filed for her mom at the same time, is this correct ? Do you guys recommend doing it or not?

What USCIS office processes these cases - NBC ? And what is the timeline ?

Another question - her mom is 61 y.o. and she is fully economically dependent on her daughter, is this a reason to ask USCIS to expedite the case ? How would we need to go about this ?

Is there an income requirement for this type case ? If so, what is the minimum income requirement ? Asking about income because she is a artist and her tax returns allow here to deduct a lot of things - last tax return was with 140K income, and 115K of deductions (so she paid around $300 in taxes for the whole year). If this poses a problem - can another person act as an economical supporter ?
And please point me to the right section on this forum if you know where it is.

I would suggest your friend come onto the forum herself. There are  many challenges with trying to get the  specific info needed to answer as accurately as possible when it’s a 3rd party posting

we were on the phone when I typed this post. She does not have a laptop, so its more convenient this way to post then she typing all this from her phone.

Yes, there is income requirement for sponsor. It's 125% of Poverty Guideline.

Can you clarify where the mom is right now? I assume she's in the US?

not only does your friend need to have the 125% of poverty guidelines for family size but should check cost of health care and yearly deductions for each policy offered.  low cost plans have deductibles in the thousands 

 

and these plans do not cover 2 basic needs of senior citizens

The Affordable Care Act does leave two forms of insurance for adults out of its provisions — vision insurance and dental coverage.

 

If the mother has any serious medical issues like diabetes this is what is said by the American Diabetes Assocation

 

The average monthly expense for a diabetic comes to be anywhere between Rs 3000 to Rs8000 per month.Nov 19, 2015

There are more issues for your friend that she has to address. 
 

Taxes - real deductions or tax fraud resulting in income below 125%. Because of this your mother may be deemed a public charge even with a joint sponsor. 
 

insurance - you have to provide medical coverage for your mother. Insurance is not cheap. 
 

work- your mother is still working age. Unless she has a disability she can find employment.

Make sure your friend is prepared to foot the bill for her mom's health insurance, which can still be hefty even if she is eligible for Medi-Cal.

It's an i-130. She petitions her mother while her mom is in Mexico. When, and only when the visa is approved, she travels to the U.S. The mother cannot use her visitor visa to travel to the U.S with the INTENT to adjust status, that's visa fraud and will result in a permanent ban from the US for the mother. Intent to immigrate has already been established at this point.

No.

Mom is in Mexico, but comes visit US often.

Noted. This is not what we are trying to achieve. She wants to bring her here so she does not have to move to CDMX to take care of mom. That's it.
