Hi,

 

We have been going back and forth, and decided to finally apply to the K1 visa. Very exciting!

 

I will be visiting both this summer and in the fall, the latter which could maybe get me some extra questions but i have a house and a job and kids at home and it is just a short stay so I am not too worried. I will be sure to bring lots of documentation that we are just spending time together and I am not moving early. However, since we still do not know how long this will take, should I apply for a new ESTA before we start the process and send the first part of the K1? I am guessing you are not supposed to apply for one after applying, and I do need an ESTA to visit from norway- My current one expires next year in July, so we might get lucky or we might not. I mean I probably would not be visiting super close to moving anyway, but if something goes wrong and our application takes more than a year that will obviously be really sad.

 

Another question.. I am about to leave on a trip tomorrow, and we will be sending the application from the states so we get the wet signatures etc etc, but is it possible for me to apply while I am in the country? I mean my ESTA is still valid but I have already renewed it once because my kids and I visited last year and then i got us new ones so we would be on the same timeline. I googled it and it said that you can technically apply while still visiting if your ESTA is expiring before you leave, but I wanted to see if anyone had any experience with this. Thanks! 😃

You don't technically apply for K-1. Your US citizen fiance files I-129F at this stage.

It just makes more sense with our situation, but we looked into both options. And the wait times have been going down lately, so we are hoping it wont be too bad. 😃

If you visit twice this year and once next year (April-June) that's plenty of visits. If you travel too often you'll risk getting in trouble with CBP. It's not a one way road either. You fiance can visit you and kids back in your home country. I wouldn't renew ESTA with 1 year still on it. Don't forget, ESTA can also be denied... No application = no denial.

You're not applying. Your fiance starts the process. Your location should not matter at this stage.
