i-864 Review Before I Send It (K1) (Merged threads)

Hello,

Here is my i-864 with personal information replaced. My fiance came on a K1 visa, I make 55,000 a year with our household of 2, and received a RFE so I'm trying to do it right this time! If someone could please review my i-864 PDF and evidence that would be awesome! 😄 (personal information was replaced with placeholders but things like what to check, household size, etc. are what worry me as I did something wrong last time). The RFE I received did not include specifics so I am just trying to redo it right.

You Need to include all you support,    You, spouse   and if you have kids.

The RFE should of said what they needed.

Include the past 3 years of Tax transcripts. 2024/2023/2022

Without more details about your RFE Letter, can't  say for certain if what you listed fulfills the RFE?

It was generic, they send the same RFE for all i-864s with instructions that could apply to multiple errors. I'm just trying to make sure I do the evidence correctly for the i-864.

Without more information, I would treat it as a brand new I-864 application along with the RFE letter, and include all evidence like a new application.

I'll include the supplement documents to your list in bold.

 

1) RFE Letter

2) Cover Letter

3) I-864 (make sure your household number is correct)

4) 2023 Tax Return Transcript, and copy of 2022, 2021 (past 3 years of tax transcripts)

5) 6 Months of Paystubs

6) Employer Letter

7) Sponsor's Passport

 

8)copy of Bank Reference Letter (can request bank to show total deposit and withdraw over the last year normally used for mortgage companies)

9) copy of Sponsor's birth certificate (if US born citizen) or Sponsor's Certificate of Naturalization (if naturalized)

10) copy of Marriage Certificate

11) copy of I-94

12) copy of foreign spouse K1 visa and entry stamp

13) copy of foreign spouse passport bio page

14) copy of foreign spouse birth certificate

15) copy of I-797 approval notice of I-129F K1 petition

 

Some of these may be redundant or not necessary.

However, I always recommend erring to the side of caution or over-documentation rather than less with USCIS because of the risks of prolonged wait time or denial.
