Application for IR-1 Visa and EAD confusion.

Hi, 

 

I'm trying to figure out if I can apply for a IR-1 Visa and EAD (work authorization) at the same time and how to go about that. I currently work as a commercial pilot in Nairobi and several airlines in the US have interest in hiring me but they do not sponsor visas. They would however employ me immediately if I have work authorization while waiting for my IR-1 Visa. Is this possible? I have been married to a US Citizen for 5 years and we currently live in Nairobi. What's the best way to go about this?

Marriage to US citizen does not confer the right to apply for work authorization. Once you enter the US via an immigrant visa, you are authorized to work.

Thanks for the response! From my understanding there is no shortcut to work while you wait for the IR-1. I simply just have to apply for the IR-1 and then the ability to work comes from that approval.

The ability to work comes with entering the US via an immigrant visa.

You cannot apply for that visa until you have an approved I-130 petition and approval from the national visa center.   Your USC spouse needs to petition you, so I suggest they join VJ and begin researching the process.   It is not easy or fast.
