That's a sweet deal for the lawyer. Take money and not be responsible for the outcome... To me, the main benefits of hiring a lawyer is for them to respond to RFEs and accompany me to interview if needed.

I'd bring the passport and GC to SSA. They may not exactly like ADIT but I think they should accept it.

Senator or congressman's aide working on federal matters for constituents should be your next step. They have direct line of communication with USCIS and can sort this out for you.

I understand the feeling, my point is you may want to form the issue in bullet points and refrain from making points that seem unrelated to each other. Officers are not really interested about all the small details and want the basics from you that are pertinent. My point about getting hung up was an extreme case but try to form your points as short and informative as possible

I am in the same situation. I filed the non-delivery request and never got a receipt. (It has been a month)

 

I also called for an appointment for ADIT stamp a month ago and no one replied to me.

 

I have tried ombudsman, but they just replied to me that USCIS has issued the receipt to me. (I could only see the PDF file, but never received the original copy.) It's useless.

 

This Monday, I called USCIS and they put an urgent request and said the tier 2 agent will call me back, but no phone calls yet. There are still 12 hours left until the 72 hr deadline, but I don't see them calling on the 4th of July.

 

I also involved the congressman this Monday, as I have travel plans coming up next week. However, I do not have my hopes high. USCIS system is messed up. No matter how I tried, no one seemed to help me with my situation.

 

My receipt number also starts with IOE and my service center is the Texas Service Center.

For what it's worth, here's how my ADIT process went: My ADIT Tier 2 callback didn't happen after 72 hours, either. I called about the ADIT on May 20. I waited 8 days from date of original phone call, then called back on May 28. The phone agent said she put a note on my file requesting a call back the same day. Didn't happen. I called back the next day, May 29, again speaking to a tier 1 phone agent. She said I was in queue for an appointment for an ADIT and that I would be hearing back by June 9. Not sure how the original deadline of May 23 (72 hours) turned into June 9, but clearly there is no accountability for USCIS sticking to their own deadlines. I ended up getting a call the evening of May 29 from a Tier 2 IO. She put in a request for a mailed ADIT. On June 6 I received my ADIT on an I-94 in the mail. I think it helped that I mentioned my GC was expiring June 16, putting some urgency to the matter, but who knows? I suggest calling back with your service item number, as the repeated calls seemed to be the only thing that worked to get my Tier 2 call back. Of course, also make sure you add the USCIS Contact Center phone number to your favourites so it doesn't get screened out as spam ((202) 838-2104). I'm waiting on another Tier 2 call now in order to press the issue of my missing receipt notice, and I have zero confidence that I'll actually be hearing back within 72 hours.

 

So disheartening to hear that the Ombudsman process didn't work for you! I had read another thread on VJ where a user had good success with it, but I think that user had a multi-year odyssey to pursue. Sorry it didn't work out for you, and that you're going through this as well. Let us know how it goes! I'll be sure to update as well, in case my experience is useful for anyone. It is so stressful! Just know you're not alone!

Seems like it would be worth a try. Worst case, nothing happens and I'm in the same place I am today, right? Is there any official material I could refer to that indicates I am a LPR even with an expired GC? I feel like with an ADIT, since it expires in a year, they'd be reluctant to give me a clean SSC. I'll report back. Thanks for the suggestion!

When I got my unrestricted SS card I had less than a year on conditional GC left. I don't think this should matter. You remain a resident, just your proof of status expires.
