I-751 pending for 5 years now

Timeline

Just refile a new I-751 with divorce waiver checked. Once ROC has been successfully adjudicated, file N400. 

 

For your case, don't file N400 with pending ROC.

 

You're wasting time waiting for that NOID. Might have been sent but you didn't get it. 

 

Just refile. With USCIS doing LIFO, you may be lucky and get successful ROC adjudication before elections. Then file N400

-I got the NOID notice. If you read my post I got it after the interview and I responded to it a year ago. 


-I switch my I-751 joined to waiver and sent my divorce decree. 
 

- I also applied to N-400 in 2021 and the case has been pending since the interview. 
 

- what are you saying to apply for another I-751 without being denied ?

You've been pending for more than 2 years. I would have already refiled. 

 

Yes. Refile. 

 

While at it (refiling), send a letter with your case numbers for N400 and I-751, withdrawing both. As I said, you may be lucky with LIFO. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

I think OP stands a better chance with LIFO. People are getting GC within 3 months. I'm sure we will be back to 1.5 years after election.

It's very optimistic to assume new case will be decided within 3 months considering it's divorce waiver and there was a NOID involved. On the other hand, lawsuit forces USCIS to make a decision within a specific timeframe.

Agree with this and to me, refiling seems like more of a roll of the dice, especially if all available evidence has been submitted and the divorce waiver was done in 2020 for a 2022 interview. Who is to say that refiling wouldn’t start the clock over on another years-long process?
