Hey guys

 

My fiance and I filed our I129F back in January, expecting to have everything ready by next year. We got lucky enough that it was approved in 3 months and we can now schedule the interview. 

The problem is that he didn’t meet the federal poverty guidelines because there were 4 months that he didn’t work as we were traveling together. We asked his mom to be our joint sponsor because we don’t want to have to wait until next year to file again and possible have to wait another 2/3 years to finally be together, but she spoke to a lawyer (not immigration) and he strongly advised her not to because he told her if I get sued (immigrant), they can go after her. 
We know we should’ve waited until he met the guidelines but we didn’t think it’d be approved as fast and we thought his mom would help if needed as she always said she wishes there was anything she could do to help us out. 
I have looked online to find out if what she was told is true but I can’t find that anywhere. Does anyone who’s been through the process have any insight? Thanks!

Does his current income qualify?  CURRENT income is king...not what was earned in past years.

if he has a permanent full time job where his annual income is more than the poverty guidelines thats what matters.

its what he's making now. so a current W-2, recent paystubs, and a letter from his employer confirming his income will be enough.

 

what is the actual likely hood that you'll  get sued for something? probably very slim im guessing lol

Also, the I134 is not binding to the person signing it, so, and I am not a lawyer, I would assume the legal liability is fairly small, and the obligation would end when your I485/I864 AOS package is approved.

 

Also, I know you are excited, but just because the I129F is approved it may still be several months before you actually have an interview.
