Hi everyone,

Was anyone able to get a marriage certificate from the U.S. courthouse before they had a religous ceremony in Canada? Our interview with the consulate is next week, our religious ceremony is in October and our priest insists on having a marriage certificate before the ceremony.

You may have a problem here,

After you get the K-1 you must marry in the USA, you can get a license and then marry at the courthouse using a Judge, and should have the Certificate, then MUST file for AOS and AP and have AP before returning to Canada for the religious ceremony.

The problem I see is if you leave the USA for the religious ceremony in October without first filing for AOS, and AP, and you leave the USA before receiving AP you will be considered to be abandoning the AOS process, and will be starting over by filing for a CR-1 or K-3 Visa.

AP can take up to 90 days to get.

It is said time and again K-1 visa petitioner's should never set wedding dates.

ARe you going to be legally married before you do the ceremony in Canada? I'm confused on the timeline.

What you are asking is to get the certificate in order to have a religious ceremony in Canada ( but the priest won't do a blessing in Canada without the certificate) and just do the legal stuff & signing of the certificate actually in the US right?

You'd have to check with the State you live in and see what kinda time frame your marriage certificate is good for, can you apply for one without you being there (if you are going to be in Canada and just want to get the document before hand) etc. That's research you'd have to do on your own, unless someone on here's from the USC's home state and has gone through the certificate process before.

I'm thinking it would be tough. I had to be there in person to sign the certificate (i'm the CDN) so I'd have to go to CT get the certificate, rush home to Canada have the blessing ceremony, then come back to the US for the legal ceremony.. sounds very complicated to me.. (and it would all have to be done BEFORE you activate your K-1 visa as well to get around the single entrance thingy)

A marriage licenses has a time period, not a certificate, the cert indicate that the couple is married.

The problem here is if you got a licence in the states, and some how had the ceremony performed in Canada you wont be fiancees anymore, and the K-1 visa would be void, and you will have to file all over for a CR-1 or K-3.

If they get married in the states, they wont have enough time to file for and receive AP before visiting Canada for a religious ceremony, NO AP in hand before leaving the USA is considered abandonment of AOS process, and a CR-1 or K-3 visa will be needed to be filed for.
