EAD pending for 5 months now >?!

All,

Thank for reading and passing on your thoughts, if any, on this topic.

We've applied for my wife's EAD back in March. The NOA date is 03/14/07.

She got her biometrics done on April 17th and after that nothing !!..........

No RFEs nor any communication from DHS/ USCIS.

Has anyone else been in a situation like this? any idea on what I can do from here?

I already went to our local office and they have no updates, neither do they issue a temp EAD.

This is very frustrating. Please help.

Schedule an info pass appointment and ask what the hold up is. It should not take more than 90 days to process.

If you filed for EAD before AOS did you file with code (a )(9 ) And send to your service center not Chicago?

Yes I did file EAD before AOS and with the code a9. It was sent to the local service ctr. and they transfered it to Vermont in a few days.

Also, I took an infopass appointment and went to the local office 2 weeks ago. They have no updates ....?!?!

I wonder if processing time has anything to do with country or biometrics checks?
Should not, all they are doing is giving work authorization. Moving the process away from the field office to the service centers, has only slowed what used to be like a trip to the DMV to a multi month pain in the ash.

If it is centralized you would think everyones approvals would be on similar schedules wouldn't they? Or at least based on their filing status right?
It should be a rubber stamp operation, receive the I-765, and payment, and send out work auth a few days later, anything over 30 days is ridiculous.

An email isn't going to do it -- in about 4 months you'll get a form letter response thanking you for your support of the rep's stance on immigration.

Go to your congressman or senator's website, download and fill out the privacy form (required for them to make an inquiry on your behalf) and brief a letter explaining your situation and your request. Fax it to their office, call to follow up, get the name, email address and direct phone number of the person assigned to your case, and stay on top of them until you get an answer.

I went to the infopass today.

I was told that CSC received our biometrics on 7/12 when we submitted them on 6/1. Why did it take so long I have no idea. She said they would send an inquiry email to CSC and that we should hear from them within 10 days.

sorry to hear of your situation. keep contacting the reps and did the local office put in an inquiry with the USCIS folks?

I am not sure if you should contact the ombudsman at this point. I contacted him and all my reps and called USCIS and finally after filing in January 2006 in May 2006, we got our EAD.

However, we are still waiting for the AOS interview or any status on our case and were told to wait another 6 months. I think we'll be waiting FOREVER. sigh...another bad week with USCIS for me..

keep the pressure on....nicely ;)

I-485 , I-765, I-130: NOA1 : 1/23/2006

Biometrics 2/23/2006

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!
