USCIS error = reason to expedite?

NO idea if this applies to our situation, but someone planted the bug in my brain so I have to ask:

 

Our case is seated at NVC now for 15 weeks and during that time, we were issued two NOA2s, the dates updated in the second issuance two months later.  Someone suggested to me that this might be grounds for expediting the case, if USCIS made some kind of error.  I have no idea how that would be applied to a case at the NVC, but I am curious if this theory has legs.  We are looking for any reason to get our case picked to go to the consulate. Been over this so many times on these forums that I feel like a broken record, but watching other K1s head to our embassy after shorter times at NVC, has set me on wanting to explore every possible option to move this along.

 

FYI, our first NOA2 expires next week, and the later NOA2 is through mid-September, so I don't even know if I need to contact the embassy to extend.  It's just a weird situation but if there's a legitimate expedite request in there, we want to submit it.

Our K-1 Journey

7 Aug 2023: I-129F petition mailed.

9 Aug 2023: NOA1, arrives approx. a week after mailing with this issuance date.

1 Mar 2024: NOA2 (v 1.0) issued.  Time between NOAs, 205 days (6 months 23 days).  NOA2 exp date 30 Jun 2024.

8 Mar 2024: NVC received case.

1 Apr 2024: after one inquiry, NVC provided case #.

8 May 2024: NOA2 (v 2.0) issued.  Same USCIS #, same case #, new exp date of 7 Sep 2024.

May-June 2024: many inquiries sent to NVC as well as the embassy, as we see other K1s with later NOA2s are sent to Johannesburg before us.  Involved senators to investigate, refused to assist without expedite request.  Emailed the White House, end of June 2024.

2 Jul 2024: case leaves the NVC for Johannesburg.  Total wait time at NVC, 123 days (4 months 1 day).

5 Jul 2024: consulate in Johannesburg receives case.

8 Jul 2024: Packets 3 & 4 received, medical and visa appointments scheduled.

23 Jul 2024: medical appointment with Dr. Brauer (Cape Town).

8 Aug 2024: visa interview with CO in Johannesburg, 16 days after medical.  Visa not issued because medical packet wasn't filed yet.  Passport and birth certificate kept by CO.  Total time from NOA1 to interview/approval, 365 days (exactly 1 year).

13 Aug 2024: email to consulate due to CEAC still displaying "Application Received" status, instead of the predicted "Refused" or "Administrative Processing".

14 Aug 2024: consulate reply, they are currently processing visa.  CEAC status changes to "Approved" (no refused or AP statuses prior).

15 Aug 2024: CEAC case status changed to "Issued"

20 Aug 2024: K1 visa in hand!

I don’t know the answer to your question, but I am at 12 weeks at NVC and waiting. Last week I got the “60 day notice” from NVC, but without any new dates included.  The notice said that my visa would be extended by the embassy, and that I didn’t need to do anything.


I wish you success in getting it expedited.  Myself, I have stopped checking online every day, since it was becoming demoralizing.  Good luck!

Compared to other K1 timelines for Johannesburg, which is all I have for metrics at the NVC stage.  People have spent 2-4 weeks at NVC after getting case numbers.  And they certainly did not get new NOA2s from USCIS.

It's psychological warfare out here. Keep your head high. Your time will come! We've waited a long time already, it sure can be demoralizing at times when we feel like we should have seen specific progress. :)

I don't check any longer either. but the USCIS Case Tracker app checks regularly for me and I trust it will give me notifications when it's time.

USCIS has a tracker app?  Does it work for NVC cases though?

I'm not sure if they're official, but there are a few out there. I found them after I had case numbers for both, but it does track!

No.   They are third party apps.

Still curious about the expedite validity, if anyone knows.  Never did get any solid feedback on that.

I am however curious about the expedite request.  Do you have any information on if USCIS errors are a reason to expedite and, if so, how do I go about pursuing that?

Aren't you past USCIS phase? They approved your case and it is NVC now. I would think if you have valid reasons to expedite you need to be contacting consulate at that point and have them request your case.

USCIS sent us an updated NOA2, so who knows where our case truly is.

Could you please illuminate me on what valid reasons exist, other than medical reasons?  As I queried in the OP, someone told me USCIS errors can warrant an expedite.  I'm looking for anyone to confirm or discredit this, as I'm skeptical but also desperate.
