Trust income for I-864?

Hello,

 

My partner and I are just beginning our visa journey (haven’t gotten married yet as we were originally considering the K1, but it looks like the CR1 is the better way to go to avoid the AOS hassle). I’m about to start a two-year full-time graduate school program here in the US, which means I likely won’t have steady employment-based income until summer 2026. However, I receive monthly disbursements of $3500 from a trust set up by my deceased parents (they passed in 2019). I checked my tax transcripts and this money shows up on the total income line where it is over the poverty guidelines.

 

Sadly, I don’t have anyone available to joint sponsor as I am not close to my extended family. If this income doesn’t count, it looks like I will need to forego the school program and get a job instead. Which is very ridiculous because this income is much more stable than a job someone can be laid off or fired from… (the trust disbursements will continue for the rest of my life)

 

I can provide 1099s, the Schedule K-1 (another K1 lol), a letter from the trust company, bank statements showing the consistent disbursements over the months/years, and the trust’s complete investment portfolio.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It is qualifying income.  That it appears on the total income line is evidenced by the tax return(s).  You'll need some direct documentation from the trust to show the income is continuing. That should be pretty easy to obtain.
