What do I need to gather for my application (in this case)?

Hi everyone,

 

Brief background: I've been married since 2015 and had my final green card by 2018. I haven't looked into applying for citizenship until now and I have recently divorced. However me and my spouse have been separated since when covid hits and I moved to a different city, I came back a couple years ago but we stayed separated and end up getting divorced this year.

 

So if I'm not applying through marriage (since it's been over 5 years of my GC), do I still need any proof of marriage for the past few years? I think the only things we kept sharing was phone bills and car insurance. Would that help?

No, except for any documents listed on the form.. You are applying under the 5 yr rule, which does not require you to still be married to the petitioner and to provide evidence of such. 

 

 read the USCIS guide to the N 400 .. passing close attention to the 5 yr option.. You will find it on the uscis website. it is simpler documentation that the 3yr option

You should be fine. But be ready to answer a question or two about marriage. Of course, have you divorce decree handy too.

I would have it but not offer / show it unless asked.

 

Did you have kids in that marriage? Evidence related to supporting kids after divorce will be helpful in this case.

CR1 Visa

USCIS STAGE: 16 days No expedite request but USC residing abroad
NVC STAGE: 19 days from case # to case complete
03/27/12: interview at Paris embassy - APPROVED
04/12/12: POE San Diego

ROC
01/15/14: sent I-751 application

05/14/14: received card production notification by e-mail, approval date 05/13

Naturalization

02/01/24: N-400 submitted online; Biometrics reuse notice received immediately online; "case being actively reviewed" after a couple hours

02/09/24: received NOA1 by mail

02/10/24: received biometrics reuse notice by mail

04/08/24: interview scheduled for 05/14. Received "We have taken an action in your case" email.

05/14/24: approved at interview, same-day oath ceremony in San Francisco 🥳 🇺🇸

 

Passport

06/10/24: application submitted at post office for passport book and card, paid for expedited processing and shipping

06/24/24: received email notification that passport was approved, then shipped with tracking number

06/25/24: passport received
