E2 renewal while change of status process

Hello everyone,

I am in process for a green card sponsored by a company for work purposes. We are filing the change of status this week which means I am not going to receive an answer until next year… I am currently under an E2 visa investor under my own business, but my visa expires mid of August, in about 2 months. My question is, do I need to renew my E2 visa or can I wait until my change of status next year? Thank you very much for all your help!

1. You're not in a process of changing status. You're adjusting status.

2. You need to be in valid status to adjust or change status.

3. What are the lawyers at the sponsoring company saying about this situation?

 

The problem with renewing E2 petition is you'll have to declare whether anybody ever filed an immigrant petition to you. Once you declare it, you may not get a renewal.
