K1 employment question

Looking to file my K1 all ready , but unemployed at the moment. Should I wait till I get a job, or get it over with and file now. And get a job before the affidavit of support comes up?. Thanks alot.

How do you plan to support an immigrant during the time when they’re not authorized to work?   How will you pay for their health care?

I can't seem to find how to reply to people , that's 8-24 months away. I'm assuming I'll have a job before then , also if push comes to shove my brother can support both of us.

While it would be better to find a job now and have a few months of paystubs under your belt, you can technically submit the i-129f now.

Finances come into question when you fill out the i-134 that your fiance will bring to their interview

Even if u find work now , your 2023 tax return would not show a full year of wages

How will u show u can afford the health care insurance to overcome the totality of circumstances so your fiancee will not become a public charge

u assume brother will support her but the I 134 is not an agreement to actually support the immigrant and is not legally binding like the I 864 for spouse visa 

I would say that u not only need a job but need to show steady employment to apply to support financially your fiancee

and u need to look into the AOS process and expenses as after a US marriage this is quite costly on top of looking into health care insurance costs in your state to show u can afford this at the interview

 

filing now without steady employment could mean a denial

probably more like 5 to 8 months away since things are processing much quicker now. You'll have to prove your income before the interview, and then again later after the interview.

Short term unemployment is probably fine, but if you have been unemployed for multiple months or even years and have taken government support like unemployment checks or EBT, then that can very negatively effect your chances of being approved.

Get a job sooner than later, and the longer you wait until after having the job, the better. I really wouldn't wait until the last minute if I were in your shoes.

 

Just because you can have a co-sponsor, doesn't mean that they won't still consider your circumstances and how you personally will be able to support your fiancé/spouse. If you can show that you can maintain a steady job/income, that's good.

 

Also throwing it out there that it sounds like, in your situation, because you won't have a continuous income to show on tax forms a co-sponsor will be a requirement, not an option at this point. That's why it's even more important to show that you too have some ability to support them.

Like everyone else said, it's not doable. You need last year's taxes to show, employers, income, etc. It just will not work. We filed end of January, we got our NOA2 last week. That's 5 months. We need the affadavit of support now. Yours might even be faster if you file now. It's simply not doable. + The whole process is EXPENSIVE. Thousands of dollars for filing, medical costs, etc. Don't start if you can't afford it or can't support your fiancé(e).

I personally would wait to file. VisaJourney member timelines show recent K-1 filers receiving approval in as little as 60 days. I am not sure where you got 8-24 months from.
