I will add my emphasis on the importance of hiring a lawyer with waiver experience.  The waiver part is definitely not a do it yourself thing.  Your questions are best answered by the lawyer you hire AFTER they have all the facts from your spouse, in confidence.

Facts are cheap...knowing how to use them is precious...

Yes, paying a fine is because of a "charge".  Traffic tickets don't count in this context, but they all have charges written on the "ticket".  Charges are things like failure to stop, speeding, negligent driving, reckless driving, etc.
