It’s been almost 10 years since I referenced this site for my green card and citizenship process.

 

Now looking to bring sibling and family to the US and have many questions:

 

Sibling and his wife are both 42 and have 2 children (9 & 7).

 

1) If Visa is granted, will this be a path to citizenship? If so, how many years until they become eligible?

2) How many years do they have to work to become eligible for Medicare at retirement age?’

3) If/when Visa is granted, do they have work authorization immediately?

4) Current processing times? Understand this could be upwards of 10 years but wondered if anyone else has recently gone through this and can share their timeline.

As it stands today 6/9/2024:

1.  After 5 years as a Green Card holder.

2.  5 Years as a Green Card holder & at least 65 years old before qualifying for Medicare.  Also, normally 40 quarters (10 years) of work credit by immigrant or spouse for free Part A.  They might be able to buy in at 65+ years old....if they have been Green card holders for 5 years.  In 2023, the buy-in cost for qualifying people was roughly $670 per month for Parts A & B. (exceptions may apply).  I wouldn't even guess as to what the healthcare system will look like in 20 years.

4.  About 20+ years.  Visa numbers are just now available for those who have priority date (I-130 submission) of Jul 2007.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Timeline

File the I-130 and other required documents. Everyone continue with their life like normal. No way to know if the children will come as derivatives or not due to various factors. In about 20 years when they get their visa they will come to the US and get a stamp in the passport that acts as a green card until the physical arrives. They can start working day one provided they also have a social security number. Five years after they obtain the green card they can apply for citizenship. 

If one of them plans on working for at least 40 qualifying quarters (10 years), so until about 72 years old,  they can apply for social security after the requirements are met and will also be eligible for Medicare.

They are looking to retire in the US?

 

File, diary it for 20 years and see what the situation is then.
