Is it possible to extend a K1 Visa?

Timeline

Can someone please let me know (or point me to a FAQ or guide) which contains information on extending a K1 visa. I dont know if it is strictly forbidden or if some have ever had any success for any unique circumstance or miraculous feats, or luck.

I appreciate all info on the subject, as you might have guessed I have have a fiancee here and our three months is running out, and we need more time!! thanks!

Once the foreign fiance has entered the US using the K1 visa, it is null and void. Their status is now derived from the I 94 form in their passport. Which is the long way of saying no, you cannot 'extend' it.

You had me confused for a moment - as TracyTN points out it's not the visa that you are concerned about.

If the marriage takes place after the 90-day period of authorized stay in the USA then you will have to submit an I-130 petition for your (then) wife along with her I-485 application to adjust status.

The visa expired the day you used it to enter the country. The I-94 starts at the point, and counts down for 90 days.

There is no way to extend the I-94 beyond the 90 days. If you don't marry in that 90 days you will be filing I-130 along with the I-485 to adjust status.

SEE: 6.13)...What happens if we do not get married within the 90 day validity of the K1 visa?

What is the hang up, you can just get a marriage license, and have a judge marry you in the courthouse, (Civil Ceremony) and just do a religious marriage later.

From the time the K-1 visa is approved/issued to the beneficiary - he/she has 6-months to enter the US. Once entered, he/she has 90 days to marry the petitioner. That's a total of just under 9-months worth of 'delay.' Do you mean you would need longer than that? (Your timeline doesn't indicate US entry yet.) :star:

*If past the 90-days (after entry to US) you can still get married and file AOS, but you'll need to file additional forms (I-130) and could experience additional delays but it's still doable. :thumbs:

After the K-1 fiance enters the U.S., you only have 90 days to get married, with no extensions possible.

You can have a very simple civil ceremony to get legally married before the 90 days is up, and then plan a bigger wedding celebration for later on.

You must be legally married before the 90 days expire, though.

I don't think there is a definitive # of days answer... In addition, accruing "out of status" time is never a good thing, so the sooner the better....

90 days is sufficiant time to get married, why is it ppl cant seem to make the 90 day mark and always want an extention? just curious. :whistle:

Marrying outside the 90 days just invites USCIS to ask questions at the AOS interview.

Some embassies will re-issue the visa if the beneficiary can not use it within the six-month period. I would suggest you check with the embassy processing your petition. Once the visa has been executed it, meaning the beneficiary arrives in the U.S., the visa is done! Good luck :thumbs:
