Hi! I am a US citizen married to a K-1 visa holder, prepping our documents to apply for the AOS.

 

I was reviewing form 1-485 Part 8 and caught that I incorrectly selected "No" when it asks whether the applicant is subject to the public charge ground of inadmissibility under INA Section 212(a)(4). I've corrected it to "Yes" and am filling in the subsequent sections I now need to complete. Some questions I have:

 

  • When it asks for household income, does that include both my income or just my husband's? My husband has no income, naturally, without his EAD yet.
  • For household assets, would that also be a combination of both of our savings or just my husbands? And for my husband, would we include his savings that are still abroad and just convert to USD?
  • For household liabilities, my husband has no debt but I do have a small balance of student debt I am still paying off. Would that be included?
  • I'm assuming supporting evidence would be required for the above, if applicable? Bank statements, student loan statements?

Part 8 Qu 62 Asks you to detail the individuals in your household. 

 

For every further question in Part 8, HOUSEHOLD refers to everyone you listed as a member of your household in Qu 62 as they are all questions WITHIN Part 8.

 

Evidence not required unless asked in RFIE/RFE.

 

Ensure you've both read through the instructions and also every bullet on each form's webpage and resulting links before attempting to fill out.  They will be extremely helpful to you.

Not correct.  All green card applicants are subject to the public charge provisions other than applications as asylee, refuge, or victims of violence, or similar.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thank you Crazy Cat.. As you can see I'm putting together AOS.. paperwork.. i have to get back in the groove of things.. there has been such a delay with my paperwork.

Crazy cat.. i don't want to high-jack this thread.. but in AOS.. paperwork.. form I-485. what is the DS 3025..
