Question regarding unsolicited evidence

Hello. I currently have my I-751 application with a divorce waiver pending. They received my application in December of 2022. It's Potomac, so I am assuming I still have a while to go before I hear anything back.

I sent a pretty complete package in my opinion (by searching this forum for advice on what to send and etc)

My question is the following : My ex-wife and I decided to give things another chance after our divorce and after I sent my application. We pretty much had been dating for the past year and a half, until we officially ended things, for good this time. Still on good terms thankfully.

Is the potential evidence accumulated during this one year relationship post marriage still applicable in anyway to prove the validity of our relationship to USCIS, or does it not matter anymore since we were no longer married? Was just wondering because during this year we accumulated more of what could be good evidence for my petition (Vacation trips together, concerts, another apartment lease)

None of the new relationship evidence would be relevant since you divorced.

 

The only evidence that matters is the one that spans your relationship while married.

 

Also, if your ex is on good terms with you and she hasn't done already, she can write affidavit saying marriage waa bonafide. The statement would include detailed explanation how your relationship started, evolved and why you divorced. Then she would say in the statement she doesn't object you getting conditions removed.

Understood. I could probably get an affidavit from her and her mom and sister as well. But should I still send it as unsolicited evidence or just wait to see if I get an RFE first?

It's up to you. Are you eligible for N-400? If yes, are you planning to apply?

I see. I will try and get the affidavits and maybe just keep them in case they ask for more, or take them with me to a potential interview. And yes, I am planning on applying for it once eligible. I became a permanent resident in 2021, so should be eligible to apply for it in 2026. Thank you for your answers.
