I-485 About To Be Denied For The Second Time

Sorry for the upper case and maybe sounding very insensitive but

 

WHATEVER HAPPENS TO THE UNCLE SHE CAN NOT GO TO GUATEMALA WITHOUT THE I-131 BEING APPROVED BEFORE SHE WOULD TRAVEL.

 

If that happens her I-485 considered abandoned and regardless she doesn't have any legal document that allows her back to the US.

Thank you to everyone who has replied so far, this has helped clarify many things for us. I made over 50k last year and will be making at least 60k this year so I don't think I need a joint sponsor. I also own a house that I'm still paying, do I need to provide proof of that for any reason? I will definitely be sending the rest of my tax information, more pay stubs, and will get a letter from my employer as you guys recommended.

Hi again. We are preparing all the paperwork to send out tomorrow and just had one last question. As I mentioned before, I meet the minimum requirement for a household of 5, but this is due to the amount of overtime hours I consistently make every week. The letter I got from my employer only states my hourly wage, and if you only consider that then I don't make enough a year to meet the minimum requirement. Will that affect their consideration? or will my tax transcripts be the deciding factor? My paycheck stubs also show that I consistently make 54-55 hours weekly. Thanks again in advance.

Yes.  CURRENT income is king.  Tax transcripts don't indicate current income.  As @Boilersaid....get a well-qualified Joint sponsor.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hats off to your work ethic …but you are complimenting things a bit.

 

If 2023 is $50K and your YTD number on recent paystub supports a certain $ per month for last 7 months…you can overcome, ..

 

But you have to NOT send the Job Letter  and on “current income “,use the $50K figure from 2023 W-2

Ok, so we have decided to add my mom as a Joint Sponsor. I know that she needs to fill out Form I-864 and also send tax transcripts from the last 3 years and paycheck stubs from the last 3 months. Other than that, what else would she have to send?

Proof of US citizenship , a copy of her DL/ID and make sure you include the W-2 with the taxes .

Don’t send W2s if sending transcripts, it only confuses USCIS and often results in an RFE for copies of the returns to go with the W2’s.
