Hello everyone,

I received an RFE and I think it is because of how I filled out the form. Is there anyone here whose petitioner receives 100% disability compensation from the Department of Veterans Affairs? He just started working in mid-2023. Before that, he was a student and fully relied on his VA disability compensation and FAFSA. So he has no filed tax prior to year 2023 and since Military disability is tax exempt. My question is, do I need to write his job on PART 6, No. 2, and his VA disability on No. 3 to total his annual income?

  1. check # 6 and fill in VA notice of disability with monthly or annual amount
  2. and send in copy of the VA letter

who is filling out this form? as u refer to the petitioner as he not me or I ?

petitioner also needs a letter from IRS that says "no return listed " for this person

He can get it from IRS

 Completed IRS Form 4506-T to the address or FAX number provided on page 2 of form 4506-T. If the 4506-T information is successfully validated, tax filers can expect to receive a paper IRS Verification of Nonfiling letter at the address provided on their request within 5 to 10 days.

Sorry my husband the petitioner is the one who filled up the form. Please see photo attached We requested that while we were processing our k1. It indicates non filling year 2022. Can I submit that together with his tax return year 2023?

 

And on Page 6. Which confuses me the most Do I put his job on number 2 and unemployment for VA? To total his annual income?

Nothing at all is completed on this page.  Check Employed as and state in the first blank, Disabled Veteran.  Employer Name is US Veterans Administration.  You mention later a K1 visa.  This form is not used for a K-1 Visa.  If you are already in the USA, using a K1 visa, are now married and adjusting status, you have posted in the wrong forum.  You are adjusting status, not seeking a spouse visa.  Please clarify.  Also add the exact wording of the RFE.
