N400 RFE Response Period Expired

Hello, I was asked for RFE after my May 1, 2024 combo I-751/N400 interview. I wanted to gather as much evidence as possible so I held off on submitting it until the last day. It said BY June 4, which in my understanding is, anytime before 12:00 am June 5. When I logged in to upload my documents this early morning (June 4), I was mortified to see that it notes that I have missed my deadline. I uploaded all my files just the same by clicking on “upload unsolicited evidence”, as this was what replaced the original “respond with evidence” button. Is this a cause for worry? Should I speak to Customer Service, and what number do I reach them? If it was a glitch, can I upload more files before midnight?

Yes.  I would get a response to them ASAP!!!!!  I would include a letter with a GOOD explanation as to why it is late.  I would beg for mercy, so to speak. Then, you wait....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

For what it's worth, I had this issue as well. I called and spoke to someone and they said on their end it didn't show as expired. It did on mine. I asked them if this was an issue or could they note it, they didn't really give me an answer. I did have a link to upload unsolicited evidence, so I uploaded everything using that link. I needed the full time to gather everything so it wasn't an option to just send it sooner (I was actually missing info 😞)

 

The person I spoke to wasn't really helpful other than to say that it didn't show as overdue in her system.

 

I sent mine this week as well, so I don't know the outcome. It might not hurt to call and ask them so they at least may have it logged that you called them. It is pretty frustrating to show a due date for June 4th and then flag it as late on the due date. It really should say Before June 4th or by 11:59 PM June 3rd or something!

Wording matters.  Time zones matter.  We all know USCIS and the DoS have terrible IT.  That RFE says BY June 4, not ON June 4.  I'm going to guess your window of opportunity slammed shut at 11:59pm ET June 3.  

 

It's best to always take a cautionary approach with USCIS.  I would have gotten that RFE knocked out ASAP.  If everything for your application was kosher, you should have been able to provide what they requested in a timely manner.  If it were a document missing that you were say, waiting to arrive from a foreign government or something, then you should have requested an extension with evidence for why you required an extension.

I'm not a native English speaker, but to me "by" = "before". And "before" is not "on" the day. I guess wording could have been better.

 

The best shot OP has is to mail everything today with post mark showing today's date. But again, wording in USCIS letter says they should receive it in the office by June 4th. So it's already late. It's unlikely petition is going to be revived. Motion to reconsider is also pointless. New N-400 petition is likely needed.

I just spoke with an immigration officer. I told her my case, and she sounded reassuring, saying “by June 4th” means June 4th is my last day, not June 3rd. She said she sees my uploads and uscis should be able to look into it soon. Looks like we’re on the same boat, and I guess we’ll have to keep our fingers crossed. Hoping for the best outcome for us!

Thank you! It was only a 2 1/2 month wait from N400 application to interview date, and I have until October this year until my greencard expires. Worst case is I’d have to re-apply, but I have all the papers that I just uploaded, so I’m ready. I just hope we’d from them soon if they ever decided to adjudicate or not.
